Terms of Service

These Terms of Service ("Terms") govern your use of the learning support service "SKILLCert" (the "Service") provided by a sole proprietor (trade name: SCBA) ("we", "our", or "us"). This is an English translation of the original Japanese Terms. In case of any discrepancy between the Japanese and English versions, the Japanese version shall prevail.

Article 1 (Application and Consent)

These Terms set forth the conditions of use of the Service. By using the Service, the user ("User") is deemed to have agreed to these Terms.

Article 2 (Account and Identity Verification)

  1. The User shall register true and accurate information, and shall promptly notify us through the prescribed method if any change occurs.
  2. The User shall manage account information themselves. Transfer, lending, or sharing of accounts to third parties is prohibited.
  3. To ensure the fairness of scores, rankings, and battle results, we may request additional identity verification from the User as necessary.

Article 3 (Service Description)

  1. The Service provides short practice question sets (10-question instant grading format) and timed mock exams (up to 20 questions / 45 minutes) to support study for certification and qualification exams.
  2. The Service provides features to visualize the User's learning status, including weekly rankings and AI-based learning diagnosis/analysis based on study results.
  3. The Service includes an online battle feature (real-time 1-on-1 match) where two Users who selected the same exam answer the same questions simultaneously and compete by score based on correctness and answer time. Battle results are stored as history and may be used as part of rankings or learning analysis.
  4. The Service provides a glossary feature summarizing key terms in the exam scope, and a flashcard feature where Users can stock arbitrary terms for repeated study.
  5. The Service provides a timeline (SNS) feature for User-to-User interaction, including posting, replying, liking, reporting, and blocking.
  6. Due to weekly maintenance, some features such as mock exams, ranking aggregation, and online battles may be temporarily suspended or restricted around every Monday 0:00–1:30 (Japan Standard Time).
  7. Mock exam sessions and similar that span the weekly boundary (Monday 0:00 JST) may be automatically terminated. In such cases, answers up to the termination point will be aggregated and saved to the extent possible.

Article 4 (Question Replacement and Feedback)

  1. The User may give one-time feedback such as "good question" or "needs improvement" for each question encountered in practice or mock exams.
  2. We strive to improve the quality of question content through weekly processing, including delisting questions that receive a certain level of negative feedback and prioritizing high-rated questions.

Article 5 (Communication Features)

  1. Like feature: Users can give "likes" to other Users' profiles or posts.
  2. Direct Message (DM) feature: Users on paid plans can send and receive 1-on-1 messages with other Users. Users on the free plan can only receive messages and cannot send.
  3. Comment feature: Users may post text on rankings, profiles, mock exam result comments, and similar in some cases.
  4. In-battle chat: In online battle rooms, simple chat with the opponent and system messages about entry/exit may be displayed. Chat content is also treated as User-generated content.
  5. Timeline (SNS) feature: Users can post, reply, like, and quote-share on the timeline for purposes such as sharing learning, asking questions, and sharing motivation. Reporting and blocking measures can be taken against posts.
  6. Community guidelines: Defamation, discriminatory expression, spam, posts solely for advertising, and other inappropriate behavior that disadvantages other Users are prohibited. If we determine a violation of the guidelines has occurred, we may delete or hide posts, or restrict account use.

Article 6 (Prohibited Acts)

  1. Acts that violate laws or public order and morals.
  2. Acts that infringe on the rights or interests of us or third parties.
  3. Acts that obstruct the operation of the Service or promote equivalent acts.
  4. Excessive request transmission via automated tools, reverse engineering, or vulnerability scanning.
  5. Fraudulent participation through multiple accounts, impersonation, or evasion of identity verification.
  6. In online battle and ranking features: intentional disconnection, collusion, proxy play, score manipulation, or other acts that lead to unfair results.
  7. Nuisance acts (harassment, abuse, spam transmission, etc.).

Article 7 (Handling of User-Generated Content, Links, and Messages)

  1. The User shall bear sole responsibility for any information posted, transmitted, published, or shared on the Service (profile comments, link URLs, ranking comments, messages, in-battle chat, timeline posts/replies, and other content; collectively "UGC"). We make no warranty as to the truthfulness, legality, or non-infringement of third-party rights of UGC.
  2. We shall bear no responsibility for damages or disputes arising from User-to-User interactions or the content, availability, or safety of linked websites. Disputes between Users shall be resolved between the parties.
  3. We may, without notice, take measures such as deletion, hiding, feature restriction, or account suspension against UGC or accounts that violate or are at risk of violating the guidelines.
  4. The User shall back up their UGC themselves; we bear no responsibility for the loss or damage of UGC.
  5. The Service may include links to third-party sites; we do not manage the content or availability of linked sites and bear no responsibility.

Article 8 (Plans and Usage Limits)

  1. We may set usage limits per plan, such as the number of practice sessions or mock exams per week, and may restrict use of the relevant feature when the limit is reached.
  2. Plan content, fees, and usage limits may be changed with prior notice.
  3. Purchase, renewal, and cancellation of paid plans are conducted in accordance with the subscription rules of each app store (Google Play / App Store).

Article 9 (Service Suspension / Maintenance)

  1. We may suspend or interrupt all or part of the Service without prior notice to Users due to system maintenance, troubleshooting, natural disasters, or other unavoidable reasons.
  2. During weekly maintenance, we will disable buttons or display warning messages for some features (mock exams, ranking aggregation, online battles, etc.) and provide reasonable guidance to Users.
  3. The Service is provided on third-party infrastructure such as cloud services. The Service may be suspended, interrupted, or experience performance degradation or data loss due to failures, defects, specification changes, API restrictions, terms changes, region failures, or network failures of these third parties. We bear no responsibility for damages arising from these and bear no obligation to refund or provide other compensation (except where required by law or app store policy).

Article 10 (Disclaimer Regarding Learning Content / AI Generation)

  1. Learning content provided by the Service includes questions, explanations, diagnoses, and term explanations generated by AI; we do not warrant their accuracy, completeness, or currency.
  2. We bear no responsibility for damages incurred by Users due to errors or omissions in learning content, weekly automatic termination (cutoff), maintenance, disconnection during online battles, etc., except in cases of our intentional misconduct or gross negligence.

Article 11 (Fraud Detection)

  1. If we detect access exceeding 10 attempts within 10 seconds on the login screen, or access exceeding 30 attempts within 10 seconds after login, we may take measures such as temporary lockout, warning display, or session termination.
  2. We may analyze access logs and usage status to detect unauthorized access, automated operation by bots, fraudulent manipulation of online battle results, etc.

Article 12 (Indemnification)

The User shall defend, indemnify, and hold us harmless from any claims, damages, liabilities, and costs (including reasonable attorneys' fees) brought against us by third parties arising from or related to the User's UGC, breach of the Terms, violation of laws, infringement of third-party rights, or violation of guidelines.

Article 13 (Disclaimer / Limitation of Liability)

  1. We bear no responsibility for indirect, incidental, special, punitive, or consequential damages, lost profits, etc.
  2. Even when our liability is recognized, the total amount of compensation shall be limited to the total amount actually paid by the User to us in the 3 months immediately preceding the date of occurrence of the event causing the claim (0 yen for free Users).
  3. The above shall apply to the maximum extent permitted by applicable law.
  4. Even if interruption, disconnection, delay, or data loss occurs during use of practice, mock exams, or online battles due to the User's communication environment (signal conditions, data communication failure, line congestion, etc.) or device failure, settings, or differences in OS / app versions, we bear no responsibility.
  5. We bear no responsibility to the maximum extent permitted by law for damages arising from failures, suspensions, specification changes, or changes in provision conditions of third-party services on which the Service relies, and bear no obligation to refund, provide alternatives, or otherwise compensate.

Article 14 (Modification of Terms)

We may modify these Terms as necessary. The modified Terms shall take effect when posted on the Service, and if the User uses the Service after such posting, they shall be deemed to have agreed to the modified Terms.

Article 15 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan. Any disputes arising from or related to the Service shall be subject to the exclusive jurisdiction of the Sendai District Court as the court of first instance.

Supplementary Provisions

  1. Use by minors: The Service is in principle intended for users aged 16 or older. Users under 16 must obtain consent from a person with parental authority.
  2. Withdrawal: Upon withdrawal, account information will be deleted in accordance with our prescribed method, but historical data such as weekly rankings, answer history, battle results, and AI diagnosis results may be continuously used and stored in a non-personally-identifiable form for statistical analysis and Service operation.
  3. Refunds: Cancellation of paid plans is conducted in accordance with the subscription rules of each app store. Fees corresponding to periods already paid are, in principle, non-refundable, except as separately specified by law or app store policy.
  4. Severability: Even if part of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
